Punishments & Penalties

Below is a summary of the punishments and penalties that the Court may impose upon the conviction of typical drunk driving offenses. However, be aware that in addition to the statutory fines the Court will impose court costs and the Secretary of State will impose driver responsibility fees that significantly increase the total cost of conviction. But remember, your arrest need not result in a conviction.

MICHIGAN OWI FIRST OFFENSE / MISDEMEANOR

   - Jail: Not more than 93 days
   - Fine: $100-$500
   - Licensing: 180 day suspension; 6 points

MICHIGAN OWI SECOND OFFENSE WITHIN 7 YEARS / MISDEMEANOR

   - Jail: 5 days to 1 year
   - Fine: $200-$1000
   - Licensing: Minimum 1 year revocation

MICHIGAN OWI THIRD OFFENSE / FELONY

   - Prison: 1 to 5 years
   - Fine: $500-$5000
   - Licensing: 1 to 5 year revocation

MICHIGAN OPERATING WITH PRESENCE OF DRUGS FIRST OFFENSE / MISDEMEANOR

   - Jail: Not more than 93 days
   - Fine: $100-$500
   - Licensing: 180 day suspension; 6 points

MICHIGAN OWVI FIRST OFFENSE / MISDEMEANOR

   - Jail: Not more than 93 days
   - Fine: Not more tha $300
   - Licensing: 90 day suspension; 4 points

MICHIGAN ZERO TOLERANCE / MISDEMEANOR

    - Community Service: Not more than 360 hours
    - Fine: Not more than $250
    - Licensing: 30 day restricted; 4 points
